Terms of Service

Estes documentos estão redigidos em inglês e italiano; é apresentada a versão em inglês.
In short
- VigiMod is in beta and free. It can be wrong and it can be unavailable: its scores are signals, you decide what to do.
- Use it lawfully, keep your keys secret, one free account per person, and tell your users their messages are checked automatically.
- Your content stays yours; we don't store it and we don't train on it.
- If you are a consumer, the protections the law gives you always apply.
1. Who we are and what these terms cover
VigiMod ("we") provides the service described here. Contact: privacy@vigimod.com. These terms are the agreement between you and us for the website, the customer area and the VigiMod API (together, the "Service"). You accept them when you create an account. The Privacy Policy explains how we handle personal data, and the Data Processing Agreement forms part of these terms.
2. The Service
VigiMod scores messages for content moderation: categories such as toxicity, hate or threats, the rules you write, the conversation context. It is in beta: features, limits and models can change, and we do not promise a specific availability. The scores come from automated models and can be wrong in both directions. They are signals for you to act on: decisions about people, especially serious ones such as bans, should involve a human. Do not use the Service as the only basis for decisions that have legal or similarly significant effects on people.
3. Your account
- You must be at least 14 years old. If you are under 18, a parent or guardian must accept these terms for you. If you use the Service for an organization, you confirm you may bind it.
- Give accurate information and keep it up to date.
- One free account per person or organization. Creating more accounts to get around the free limits, or to come back after a block, is not allowed.
- Keep your password and API keys secret, do not share or resell keys, and revoke a key immediately if it leaks. You are responsible for what is done with your keys until you revoke them.
4. Acceptable use
You may not use the Service to:
- process content you have no right to process, or break any law, including data protection law;
- harass, profile or monitor people beyond moderating your community, or discriminate against them;
- build or train a competing model or service from VigiMod's outputs, or copy, reverse engineer or resell the Service;
- attack, overload or probe the Service, get around its limits or security, or access accounts that are not yours.
When you moderate other people's messages with VigiMod, tell them, for example in your community rules or privacy notice, that messages are checked by an automated moderation service.
5. Your content and personal data
The content you send remains yours. You give us only the permission needed to process it to return the scores. We do not store it, we do not use it to train models and we do not share it. For the personal data in that content you are the controller and we are your processor, under the Data Processing Agreement; you are responsible for having a lawful basis to send it to us.
6. Price
The Service is free during the beta. Paid plans may come later: we will announce them in advance, the free use you already have will not turn into a paid one without your explicit agreement, and the terms of any paid plan (including the right of withdrawal for consumers) will be given to you before you buy.
7. Intellectual property
The Service, the models, the website and the VigiMod name and logo belong to us. We give you a personal, non-exclusive, non-transferable right to use the Service under these terms. If you send us suggestions, we may use them without obligation.
8. Suspension and closing the account
You can delete your account at any time from the dashboard. We may suspend or close an account, revoke keys and block the devices or networks used, if these terms are seriously broken (for example abuse, multiple free accounts, attacks, illegal use) or if the law requires it. Where possible we tell you first and give you a chance to explain; you can always contest a decision by writing to privacy@vigimod.com. We may end the beta or the Service, giving at least 30 days' notice except in case of emergency.
9. Liability
The Service is free and in beta, and is provided "as is". To the extent permitted by law, we are not liable for indirect damages, for decisions you or your community take based on the scores, or for interruptions of the Service. This does not limit liability for intent or gross negligence, for death or personal injury, or any right that cannot be limited by law, and it never reduces the rights consumers have under consumer protection law.
10. Your responsibility
If you use the Service for a business or professional purpose, you will hold us harmless from claims by third parties caused by content you send or by your use of the Service in breach of these terms or of the law.
11. Changes to these terms
We may update these terms, for example for new features or legal changes. We will tell you about important changes by email or in the dashboard at least 30 days before they apply (sooner only when the law requires it). If you do not agree, you can delete your account before then; if you keep using the Service after that date, the new terms apply.
12. Consumers
If you use the Service as a consumer (for purposes outside your trade or profession), the mandatory protections of the law of the country where you live apply in addition to these terms, and disputes go to the court of the place where you live (art. 66-bis Codice del Consumo, for consumers in Italy). Please write to us first: most issues can be solved quickly.
13. Applicable law
These terms are governed by Italian law, without prejudice to the consumer protections in section 12. If a clause is invalid, the rest stays in force.
14. Specific approval of clauses
Under articles 1341 and 1342 of the Italian Civil Code, when creating an account you specifically approve the following clauses: 3 (one free account per person), 8 (suspension and closing of the account by us), 9 (limits of liability), 10 (your responsibility) and 11 (changes to these terms).
